Biography
A partner in Seyfarth Shaw LLP's Atlanta office, Mr. Myers' practice focuses on intellectual property and technology business matters.
Mr. Myers directs teams of legal, docketing and administrative personnel, and foreign counsel, in the management of large international trademark portfolios. His work includes all aspects of trademark portfolio management, including global brand strategy, prosecution and maintenance, searching and clearance, watching and policing, licensing and distribution, domain name and other Internet issues, and the management of all types of litigation, oppositions, cancellations and other adverse proceedings, domestic and international. In recent years, Mr. Myers has spearheaded the firm’s efforts to apply lean Six Sigma and SeyfarthLean principles and methodologies to the area of global trademark practice to achieve higher quality and enhanced efficiency at reduced cost.
Mr. Myers also has substantial experience in technology transactions, including the structuring and negotiation of license, development, distribution, and other transactions involving software, technology, databases, patents, trademarks, and copyrights. Mr. Myers provides industry-focused representation specifically to software companies, including in connection with software company M&A transactions, licensing and SaaS contracting, copyright and trade secret counseling, cloud computing issues, and open source matters.
Representative engagements include the following:
- Ongoing management of multiple large international trademark portfolios for various publicly-traded and large privately-held U.S. companies in various industries, including software and technology, footwear and apparel, consumer products, automotive products and other industries
- Ongoing management of software and technology contracting processes for various middle market software firms
- Completion of simultaneous copyright registration of over 100 software and multimedia products for publicly-traded U.S. software company
- Management of $130 million merger of private software company into NASDAQ company, with direct supervision of intellectual property matters, including negotiation of intellectual property representations, warranties and disclosure schedules; management of international trademark, patent and open source diligence; and various information technology issues
While in law school, Mr. Myers authored: Speaking Frankly about Copyright Infringement on Computer Bulletin Boards: Lessons to be Learned from Frank Music, Netcom, and The White Paper, 49 Vand. L. Rev. 439 (1996).
