Building upon three decades serving clients in the waste disposal, treatment and recycling industry, Seyfarth has developed a leading practice in the area of landfill gas and other forms of alternative energy.
Combining regulatory know-how with extensive contracting and negotiation experience, we provide a full range of services to landfill gas projects. We have represented project developers, landfill owners and end-users on gas projects across the country and in a wide variety of settings. We have assisted in the permitting process, defended landfill gas enforcement actions, as well as nuisance claims brought by residents complaining of gas migration and odors. We also participated in a long-running bankruptcy of a major landfill gas developer and experienced first-hand many of the things that can wrong with these projects. Last, our deep bench in the Clean Air Act and the Resource Conservation and Recovery Act enables us to take a broad view of the multiplicity of issues facing landfill gas projects.
For our alternative energy clients, we bring a multi-disciplinary team, including members of our corporate and tax groups, to work on projects ranging from wind and solar to hydropower and ethanol. We have assisted a number of clients in taking advantage of the various state and federal incentives available for alternative energy projects, including grants, tax credits, and bonds. We are also familiar with the valuation and use of environmental attributes such as renewable energy credits and carbon credits.
