Mr. Ingraham is a partner in the Atlanta Office and is Chair of that office's litigation department and Co-chair of the firm's national construction practice.  For more than 30 years, his practice has focused on construction law and complex commercial litigation. Mr. Ingraham represents owners, contractors, design professionals and sureties in a wide variety of construction-related matters.  He has served as lead counsel in the litigation or arbitration of construction, surety and environmental remediation disputes throughout the United States, including trying approximately one hundred cases to verdict or arbitration award.  Mr. Ingraham’s work also includes drafting contracts, negotiating contract amendments and modifications and advising clients on contracting and claims avoidance issues.

Mr. Ingraham serves as an arbitrator in construction industry disputes before the American Arbitration Association, serves as a mediator and is a frequent lecturer on legal issues facing the construction industry. 

Mr. Ingraham has litigated and arbitrated a wide array of complex commercial disputes.  These cases have included defending insurance carriers and third party administrators in contested life insurance matters, pursuing and defending claims against directors and officers for breach of fiduciary duty, and defending a claim for breach of a literary contract.  Mr. Ingraham also has handled numerous claims for breach of sales contracts, the enforcement of financial guarantees, and the confirmation of real estate foreclosure deficiencies.  

A friend and supporter of the National Foundation to End Senior Hunger, Mr. Ingraham  was recently elected to the organization's Board of Trustees.  The Foundation is the only research entity of its kind focused exclusively in the areas of senior hunger and senior nutrition in the United States.

Representative Engagements

  • Successfully mediated settlement whereby owner’s default termination of contractor client was converted to a termination for convenience and client was reimbursed in excess of $8 million.
  • Achieved a defense verdict in a jury trial for an owner against a contractor’s claim for additional costs in the construction of an office/retail complex.
  • Successfully defended a design professional client in litigation against a $15 million claim filed by a prime contractor on a performing arts center, resulting in a mediated settlement of substantially less than the client’s anticipated costs of defense.
  • Developed library of standard contract documents for use by contractor client.
  • Drafted and negotiated the design-build construction management agreement for the renovation of three buildings within the school of music of a major urban university under a fast-track contract.
  • Successfully mediated contractor client’s multi-million dollar recovery for extra work, delays and impact costs against owner and design professionals in connection with the construction of two science and engineering buildings at a regional university.
  • Achieved defense verdict at trial in federal court on claims of negligence in a third party administrator’s management of a life insurance policy under an employee benefit plan.
  • Achieved substantial verdict on behalf of bridge contractor on claims for delays and additional work after a multi-week jury trial. 
  • Successfully confirmed foreclosure deficiency in a highly contested confirmation action.
  • Favorably resolved at mediation the contractor’s claim for extra work required in the environmental clean up of a Superfund site.
  • Defeated a claim for breach of a literary contract in arbitration.
