David A. Klein is counsel at Seyfarth Shaw LLP's Boston office, where he focuses on preparing and prosecuting patent applications, intellectual property counseling, and litigation support.  Mr. Klein is a registered patent attorney with experience including patent portfolio development strategies, administrative appeals, validity and non-infringement analysis, patent assertion and assertion defense.  He has worked on reexamination and interference matters, and in technology transactions has been involved in due diligence, licensing and risk mitigation.  Mr. Klein has worked on matters involving comparative patent law considerations, and on matters in the International Trade Commission (ITC) and particularly involving establishment of domestic industry under ITC Section 337. 

Mr. Klein has represented clients in a wide variety of technologies, including electronics, photonics, semiconductor manufacturing, telecommunications, network architecture, software, e-commerce, and medical devices.

Representative Engagements

  • Represented a leading fabless semiconductor company in patent licensing negotiations in relation to semiconductor devices.
  • Represented a leading computer manufacturer in competitive patent infringement actions in district court and before the U.S. International Trade Commission.  Resulted in a confidential settlement.
  • Evaluated intellectual property assets for a leading e-commerce company in support of strategic acquisitions, including assessment of quality, intrinsic value, potential uses, and downsides if not secured.
  • Represented a semiconductor wafer and optoelectronic device manufacturing company in ex parte and inter partes matters before the U.S. Patent and Trademark Office related to an ongoing patent infringement litigation. 
  • Represented an ophthalmic laser manufacturer in defensively asserting patents in an infringement action in district court.  Resulted in a confidential settlement.
