Gregg Dulik is a partner in the Construction Practice Group of Seyfarth Shaw LLP and is based in the firm’s San Francisco office.  For over 30 years, Mr. Dulik has assisted owners, general contractors, subcontractors, architects and engineers in every phase of the public and private construction process, from initial project planning through final dispute resolution.  He knows the construction industry well, and is a skilled advocate for his clients in mediation, arbitration and litigation.

Mr. Dulik has extensive experience drafting and negotiating construction and design contract documents; handling bid protests and licensing issues; counseling clients during the course of construction in order to help them minimize project risks and maximum the potential for project success; and pursuing and defending claims of all types, including claims for delay and disruption, extra or defective work, incomplete or defective design, differing site conditions, terminations for default and convenience, lien and bond issues, and post-completion warranty issues.  Over the years, Mr. Dulik has worked on a wide variety of projects, including power plants, refineries, manufacturing facilities, infrastructure improvements, commercial buildings, hospitals, hotels, dormitories, sports stadiums, parking structures, military installations, detention facilities, multi-unit housing developments and high-end private residences. 

Mr. Dulik is a member of the Legal Advisory Committee for the Associated General Contractors of California.  He repeatedly has been recognized as one of the leading construction lawyers in Northern California through an annual peer-review process conducted by Super Lawyers magazine.

Representative Engagements

  • Prosecuted significant claim by highway contractor against designer and manufacturer of a bridge system component installed on multiple California Department of Transportation projects. Arbitrator awarded the contractor 95% of its claimed damages and 100% of its legal fees.
  • Defended construction manager against design-build subcontractor’s $84 million modified total cost claim arising out of the construction of Miller Park, the home of the Milwaukee Brewers professional baseball team. Defeated the bulk of the subcontractor’s claim through a summary procedure, and then resolved the balance in mediation on terms very favorable to the construction manager.
  • Defended international design firm against general contractor’s $30 million claim for cost overruns resulting from the allegedly defective design of a hospital expansion project. Resolved the claim in mediation on terms extremely favorable to the designer.
  • Prosecuted general contractor’s multi-million dollar claim against an owner for defective design and excessive changes in connection with the construction of a $20 million residence. Defended against the owner’s delay claim. Following 51 days of arbitration, the arbitration panel awarded the contractor over 95% of its claimed damages and legal fees and denied the owner’s claim in its entirety.
  • Assisted OCIP carrier in analyzing claims and assessing insurance coverage in connection with the construction of the CityCenter Project in Las Vegas, the largest commercial construction project in U.S. history.
  • Prosecuted designer’s breach of contract and fraud claims against a private developer in connection with two turn-key construction projects for a municipality. Obtained trial court award in favor of designer, which was upheld on appeal.
  • Assisted international pharmaceutical company in developing a complete set of design and construction contract document templates.
  • Prosecuted EPC contractor’s multi-million dollar delay and disruption claims against a public agency arising out of the rehabilitation of a geothermal power plant. Resolved the claims in mediation on terms very favorable to the contractor.
  • Assisted wind turbine manufacturer to develop litigation strategy and achieve early resolution of various design defect and warranty claims.
  • Defended solar energy developer against claims by an EPC contractor arising out of the design and construction of a solar farm.  Resolved the claims in an early mediation on terms very favorable to the developer.
  • Represented technology company in a series of arbitrations against a developer regarding the lease terms for a corporate campus complex in the Silicon Valley.
  • Defended an international building materials manufacturer in multiple product liability and breach of warranty cases throughout California.  The defense verdict obtained in one of these cases, Regency Park v. Weyerhaeuser, was recognized by the San Francisco Daily Journal as one of the “Top Ten Defense Verdicts of the Year.”
