Mr. Plasencia is counsel in the Sacramento office of Seyfarth Shaw LLP and is a member of the Real Estate Department.
 
Mr. Plasencia served as primary in-house Senior Counsel to CalPERS’ Real Assets portfolio for over 15 years. He advised on and managed all legal aspects of the Real Assets portfolio, including commingled funds and direct investment acquisitions and dispositions, separate accounts, emerging managers, and development of Real Assets investment policies and procedures.  Mr. Plasencia worked extensively with Real Assets staff, legal staff and outside counsel on the implementation of CalPERS’ alignment of interest model for its Separate Account investment program.  He addressed and negotiated terms consistent with CalPERS’ fiduciary duties and policies.  He addressed issues pertaining to indemnification, governance issues, fair market values, dispute resolutions, compensation/incentive fees, CalPERS' tax-exempt status, ESG, placement agents, insurance claims and litigation, appraisals, and conflicts.  He responded to Public Records Act requests for investment documents while balancing the need for public disclosure and confidentiality.  Assisted in litigation defending exempt records from disclosure.  Mr. Plasencia reviewed and advised on real estate RFPs and government contracts, including valuations, insurance brokers, and board consultants.  He worked extensively on real estate matters and compliance with the California Public Employees’ Retirement Law, the California Public Contract Code, and applicable federal laws.  Prior to being fully assigned to the Real Estate Unit, Mr. Plasencia represented CalPERS on benefit related issues, such as member classification and final compensation issues.
