Jesse Coleman is a partner in the Litigation Department of Seyfarth Shaw LLP. His practice encompasses various types of civil litigation facing the health care industry, energy industry, and related industries. In the health care industry, he has represented hospital systems, medical device companies, staffing agencies, managed care organizations, insurance companies, and physician practices in matters involving contract disputes, peer review and credentialing proceedings, Medicaid bid protests, antitrust claims, defamation claims, EMTALA claims, ERISA claims, professional liability claims, and regulatory matters before state and federal agencies.

Mr. Coleman has also represented and counseled health care, hospitality, and energy-sector clients in numerous trade secret and non-compete disputes.  Mr. Coleman has developed a specialized practice in prosecuting and responding to temporary restraining orders and preliminary injunctions in this area of law.

Prior to private practice, Mr. Coleman completed a one-year clerkship with the Honorable Thomas Reavley, United States Court of Appeals for the Fifth Circuit in Houston, Texas. Prior to this clerkship, he completed a two-year clerkship with the Honorable Kathleen Cardone, United States District Court for the Western Division of Texas in El Paso.  While in law school, Mr. Coleman also served as a judicial intern for the Honorable Marian Blank Horn, United States Court of Federal Claims.

Mr. Coleman was selected in 2016 and 2017 by Super Lawyers as one of its Texas Rising Stars in Health Care Law, an honor limited to no more than 2.5 percent of attorneys in the state. Mr. Coleman has been selected by The Legal 500 United States as a 2016 Recommended Attorney in Healthcare.

Mr. Coleman currently serves as vice chair of the firm’s Health Law Practice Group and co-chair of the Health Care Litigation Subgroup.

Representative Engagements

  • Represented hospitals and insurance companies in antitrust, business torts, and breach of contract lawsuits, bringing matters to successful settlement or favorable trial verdicts
  • Advised clients on regulatory issues involving Stark, Anti-kickback, and False Claims Act statutes.
  • Successfully litigated multiple trade secret and non-compete matters, assisting clients in protecting their trade secrets, obtaining injunctive relief, and defending against claims of misappropriation
  • Successfully led and participated in numerous physician due process hearings on behalf of medical staffs and hospital system, resulting in upholding physicians' summary suspensions, revocation of clinical privileges, denial of reappointment and removal from hospital medical staff
  • Represented managed care organizations in Medicaid bid procurement disputes, including trying a case in the State of Ohio to successful directed verdict and dismissal of all claims, which he then successfully defended on appeal
  • Represented healthcare system in evaluating potential privacy data breach under state and federal law, and further developing and implementing mitigation response protocol
  • Advised and represented Employee Welfare Benefit Plans in ERISA claims brought for claims payment and breach of fiduciary duties.
  • Successfully negotiated settlement agreements on behalf of managed care organization in contracts disputes and insurance claims disputes
  • Managed, directed and coordinated massive on-site document production effort on behalf of managed care organization client, in response to investigation by the Texas Office of Inspector General (OIG), ultimately resulting in favorable settlement agreement
  • Engaged in numerous successful mediations with disruptive physicians on behalf of hospital system client, resulting in physician's withdrawal of application for reappointment and withdrawal from medical staff
  • Assisted hospital system in reformulating subpoena policies and release-of-information policies as they relate to HIPAA regulations, federal substance-abuse laws, Texas privacy laws, and laws governing the release of Sexual Assault Nurse Examination materials
  • Advised hospital system client on medical staff bylaws revisions, legal defense strategies in peer review proceedings, formation of new leadership committees and drafting additional contract provisions between hospital system and joint ventures
  • Appeared on behalf of hospital system client and successfully prosecuted numerous motions to quash and motions for protection of medical and forensic records from civil/criminal subpoenas
  • Assisted in representing medical device companies in criminal securities fraud litigation against former company executives and in finalizing settlement negotiations for civil litigation
