Lucas Deloach is an associate in the Labor & Employment Department and a member of the firm’s national Wage & Hour Litigation Practice Group.  He primarily focuses his practice on defending employers against claims arising under federal and state wage-and-hour laws.  His litigation experience ranges from complex class and collective actions involving thousands of employees to single- and multi-plaintiff claims.  Mr. Deloach also represents employers in agency investigations, including those conducted by state departments of labor and the U.S. Department of Labor’s Wage and Hour Division.
 
In addition, Mr. Deloach provides practical and proactive counseling to assist employers in their day-to-day compliance efforts.  Beyond routine advice, he conducts pre-acquisition due diligence reviews and compliance audits regarding the classification of employees as exempt or non-exempt, pay practices with respect to non-exempt employees, and the classification of certain workers as independent contractors.
 
Although his experience spans many industries, Mr. Deloach has notable expertise in the home care and home health care industries. He regularly provides industry-tailored compliance counseling and utilizes his industry knowledge to draft and review employment agreements, independent contractor agreements, master service contracts, and company policies.  He also speaks to both industry associations and franchise owner conferences about wage-and-hour developments impacting the industry.
 
Before entering private practice, Mr. Deloach clerked for the Honorable James P. Jones in the United States District Court for the Western District of Virginia.
