Mark Thacker is an associate in the Labor and Employment Department in the Atlanta office of Seyfarth Shaw LLP where he defends employers throughout the United States against wage and hour claims arising under the Fair Labor Standards Act and state law. These claims range from single plaintiff claims for overtime pay to more complex collective and class actions. Mr. Thacker has coordinated and drafted prevailing motions for decertification and motions opposing conditional class certification. He provides preventative counseling to employers seeking to limit their exposure to government investigation and litigation under wage and hour laws that require employers to pay overtime and minimum wages to their employees.

In addition to wage and hour matters, Mr. Thacker also represents clients in a wide variety of labor and employment issues. He has obtained favorable settlements, dismissal orders, and summary judgment for clients in breach of contract cases, as well as in actions arising under Title VII of the Civil Rights Act, the American with Disabilities Act, and the Family and Medical Leave Act. Mr. Thacker has also litigated cases arising under the Occupational Safety and Health Act. He has co-managed OSHA fatality cases in general industry and construction, including dust and chemical plant explosions. He has also defended clients against various whistleblower actions and actions investigated by different government agencies, such as OFCCP, EEOC, and OSHA.
