Ms. Mellinger is a Labor & Employment attorney at Seyfarth Shaw LLP, where her practice has a specific focus on the area of OFCCP compliance and affirmative action. She has extensive experience representing federal contractors and subcontractors in connection with compliance evaluations conducted by the Office of Federal Contract Compliance Programs, from pre-compliance review and analysis through successful closure. She has successfully represented many clients during OFCCP onsite investigations, involving both minor and major issues including allegations of class-wide discrimination. Ms. Mellinger has significant experience engaging in conciliation discussions with both OFCCP and the United States Solicitor’s Office. She has represented many large, national companies as well as smaller organizations in such disputes. Michelle also has substantial experience successfully challenging OFCCP jurisdiction. She also provides preventive guidance to federal contractors and subcontractors and trains contractors about affirmative action best practices including legally-compliant recruiting, selection, applicant tracking, pre-employment testing, performance management, compensation, and other employment processes and procedures; and provides preventive counseling with respect to other federal contractor obligations arising under Executive Order 11246, the Vietnam Era Veterans' Readjustment Assistance Act of 1974, the Rehabilitation Act of 1973, and other laws and regulations applicable to federal, state and local contractors.

In her broader employment law practice, Ms. Mellinger counsels and advises clients on the full spectrum of workplace related issues.  She regularly represents management in the litigation of federal and state employment discrimination lawsuits and charges brought under Title VII of the Civil Rights Act of 1964 (Title VII), the Age Discrimination in Employment Act (ADEA), the Americans with Disabilities Act (ADA), the Family and Medical Leave Act (FMLA), and numerous related state laws and municipal ordinances.  She has successfully defended clients in litigation ranging from single plaintiff to large class action matters.  She also assists companies with workplace investigations and in the settlement and negotiation of employment-related disputes. 

Prior to joining Seyfarth Shaw LLP, Ms. Mellinger served as an extern in the Chambers of Judge Milton Shadur in the U.S. District Court for the Northern District of Illinois and at the City of Chicago Sexual Harassment Office.
