Ms. Kwan is a Counsel in the Sacramento office of Seyfarth Shaw LLP and is a member of Seyfarth’s Labor & Employment Department. Ms. Kwan represents employers from a diverse array of industries, including agriculture, tech, insurance, healthcare, and retail in all aspects of labor and employment litigation, including discrimination, harassment, wrongful termination, retaliation, wage and hour, and class action matters in state and federal courts.  She has defended numerous single and multi-plaintiff cases alleging claims for discrimination and harassment under the California Fair Employment and Housing Act, Title VII, the Americans with Disabilities Act, and the Family and Medical Leave Act.  
 
Ms. Kwan has also defended a variety of large wage-and-hour class and collective actions alleging unpaid wages, misclassification, meal and rest period violations, unfair business practices, wage statement violations, and other federal and state wage claims.  She has experience in numerous aspects of class litigation, including drafting discovery motions to limit the scope of class discovery, conducting state-wide declaration gathering projects, and drafting motions related to class certification.  Ms. Kwan has been an integral part of several teams that obtained denials of class certification in a meal break case involving a proposed class of over 5,000 employees, a misclassification case involving assistant managers of a grocery chain and a misclassification case involving independent contractors.
 
Ms. Kwan regularly authors management alerts and blog posts in various developments in employment law.  She is also a Contributing Author to Chapter 8 (Discovery Issues in Collective and Class Actions) in the “Wage & Hour Collective and Class Litigation (The Definitive Treatise on Wage and Hour Litigation.)," ALM Law Journal Press (2012).
 
Ms. Kwan is a member of Seyfarth Shaw’s Diversity Action Team, Asian Affinity Group, and Women’s Affinity Group.  Outside of work, she serves as the Vice President of the Asian Bar Association of Sacramento and the co-chair for the Sacramento County Bar Association, Diversity Fellowship Committee.
