Steven J. Pearlman, associate in the Chicago office, will be presenting Understanding the Impact of Smith v. City of Jackson, during the upcoming 2007 Joint Conference of the American Society on Aging and the National Counsel on Aging.  This is a three-day conference for over 4,000 members of the American Society on Aging and the National Counsel on Aging and other professionals. It will address policies, research and a broad spectrum of topics related to the field of aging.

This presentation will discuss the Supreme Court’s recent ruling in Smith v. City of Jackson, which addresses the availability of “disparate impact” claims under the Age Discrimination in Employment Act. The presentation will focus on the showing employees must make to proceed with such claims and the defenses available to employers. It will also include a survey of how courts have interpreted and applied the Smith decision.
