Chris DeMeo, a partner in Seyfarth's Health Law Department, will be co-presenting The Knowledge Group webcast "Stark Law: Recent Trends, Developments and Updates" on April 26 from 3 - 4 PM (ET).

The Physician Self-Referral Law or “Stark Law” remains a top policy priority as policymakers continue to fight against healthcare fraud and abuse. A disclosing party under the Voluntary Self-Referral Disclosure Protocol (SRDP) is now required to submit four forms which include the SRDP disclosure form, the physician information form, the financial analysis worksheet, and a certification stating the truthfulness of the information provided.

On the other hand, the penalties for Medicare and Medicaid fraud and abuse violations have been increased under the Bipartisan Budget Act of 2018. The Act also codifies certain Stark Law changes involving signature and writing requirements as well as holdover arrangements. Further reforms are expected as the Centers for Medicare & Medicaid Services (CMS) modernizes the Stark Law towards value-based payments under Medicare.
