The past decade has seen tremendous growth in the use of mediation as an alternative to the litigation of employment disputes. The ethical dimensions present in mediation can put parties in challenging and conflicting and positions. As an employer, it is important to have a clear understanding of the role of the mediator and the principles that govern the relationship.
