With the Obama Administration’s focus on enforcement of employment laws relating to the hiring process, and the corresponding uptick in private actions, employers need to take a closer look at their hiring practices.  While employers need to minimize their legal risks, they also have a pressing need to ensure that applicants satisfy their legitimate requirements.  Once these competing concerns are understood and accounted for, employers can begin to strike the right balance.
