Outside of the United States, different data privacy laws and regulations apply.  Many countries impose restrictions on the transfer of data to and from those countries, which can have significant implications for multi-national companies.
 
Seyfarth eDiscovery Counsel Kathleen F. McConnell, along with a panel of eDiscovery experts, will present “Cross Border Data Privacy and Privilege” at the Ing3nious Southern California eDiscovery and Information Governance Retreat. This panel will discuss ways to handle obtaining data from different countries and best practices for dealing with the flow of information in the European Union and other foreign countries.  They will also discuss how to manage cross border privilege issues including how to determine whose privilege law applies, how communications with foreign lawyers will be treated, whether U.S. attorney-client privilege protection can be waived by disclosure of information outside of the United States, privilege issues in the European Union and strategies for companies who do business in countries that do not acknowledge privilege.
