Ward Kallstrom, partner of Seyfarth’s Labor & Employment department and co-chair of the firm’s Health Care Fraud and Provider Billing Litigation Team, is a panelist on an upcoming webinar presented by the ABA Joint Committee on Employee Benefits (JCEB). JCEB is an umbrella organization comprised of leadership from the employee benefit committees of six ABA sections. The webinar, titled “The Gathering Storm: How Should Plan Fiduciaries Address Health Care Provider Overbilling?”, will take place on June 9, 2015 from 12:00 - 1:30 pm CT.

Over the past several years, the federal government has taken an aggressive stand against alleged overbilling to government health programs (such as Medicare) by health care providers. Similar issues affect private health plans. Plan fiduciaries must investigate and take action to remediate overbilling because ERISA compels fiduciaries to act prudently and in accordance with plan provisions. Providers must be prepared to defend against claims of misconduct by ERISA plans, their insurers, and agents.

Panelists will discuss the actions that plans can take to remedy health fraud (under ERISA and otherwise) and will address these issues from the perspective of medical providers. The program will address plan design, service provider contracts, offsets of payments to providers, and the impact on participants and beneficiaries. Litigators and counselors will benefit from this discussion.
