12:00-1:30 p.m. Pacific

Prior to the creation of a federal private right of action by the recently-enacted Defend Trade Secrets Act, companies were limited to state laws for protection against trade secret theft. This program walks you through the key features of the DTSA, including the civil seizure remedy preventing dissemination of misappropriated trade secrets.

Join Seyfarth Shaw partner Robert Milligan, co-chair of the firm’s Trade Secrets, Computer Fraud & Non-Competes Practice Group, at this Continuing Education of the Bar (CEB) program to learn how the DTSA compares to its state counterparts, and for practical advice on complying with the new law. Mr. Milligan also will provide tips and litigation strategies for bringing or defending federal rights of action under the new law.

Program Highlights:
  • How the Defend Trade Secrets Act compares to the Uniform Trade Secret Act
  • Ex parte seizure orders
  • Requirements for whistleblower immunity
  • Considerations for bringing a federal claim, state claim, or both
  • What companies should do to avoid litigation
  • Other recent developments and trends in trade secret litigation
This is an intermediate level program and assumes some intellectual property law experience.
