The EB-5 Immigrant Investor program offers foreign investors a pathway to green card status through an investment of as little as $500,000 as long as the investment creates 10 jobs for U.S. workers. The program presents corporate, securities, finance and immigration lawyers with an opportunity for cross-disciplinary collaboration. There are land mines aplenty for attorneys practicing in the EB-5 ecosphere, as clients -- whether investors, developers or regional centers -- try to maneuver through complex and arcane immigration regulations while complying with more heavily regulated securities laws and rules. This advanced panel will address the direct and regional center EB-5 programs, analyze the advantages and demerits of each, explain policy guidance issued by U.S. Citizenship and Immigration Services, describe the "at risk" investment requirements, and offer tips on documenting investors’ lawful path and source of funds.
