I. CFPB Developments

Scott M. Pearson, Co-Chair of Seyfarth Shaw’s Consumer Financial Services Litigation practice group, will discuss recent developments in regulation and enforcement actions by the Consumer Financial Protection Bureau that affect lenders.  Topics will include the Bureau’s regulatory and enforcement priorities, lessons learned from recent enforcement actions, pending challenges to the CFPB’s authority and constitutionality, mortgage and other rulemaking, fair lending and debt collection issues, and strategies for dealing with CFPB audits, investigations and enforcement actions.  (1 hour MCLE credit)*

II. Privilege Pitfalls for In-House Counsel

William F. Dugan, Chair of Seyfarth Shaw’s Financial Services Employment Arbitration practice group, will address how best to protect corporate communications and avoid waiver of applicable privileges.  Topics will include the test for determining whether privilege exists, the role of the attorney, who is the “client” for purposes of privilege and the work product doctrine for in-house counsel.  (0.5 hour CLE Ethics credit)*

*1.5 hours of Indiana CLE Credit (including 0.5 ethics) (CLE accreditation will be applied for but is not guaranteed)
