Earlier this year, the Massachusetts Commission Against Discrimination (MCAD) issued its Guidance and Q+A addressing the Massachusetts Pregnant Workers Fairness Act (PWFA) which goes into effect on April 1, 2018.
The PWFA expands the Massachusetts anti-discrimination statute to specifically prohibit discrimination against individuals due to pregnancy or pregnancy-related conditions (including breastfeeding), and to require reasonable accommodations when necessary. It imposes a number of new obligations on employers and will require employers to review their current policies and processes to ensure that they comply with the new law.
