Condon McGlothlen was quoted in an August 26 story “The Morning Risk Report: Retailers Should Consider Employment Law Issues Before Closing Stores” in the Wall Street Journal on why retailers need to consider employment law and supply-chain implications before deciding whether to shutter stores, leave markets or go out of business. McGlothlen said that, while such decisions are driven by business factors more than compliance concerns, among the issues retailers need to consider are whether closures will trigger federal worker notification requirements, whether employees will be entitled to severance pay and other benefits and what impact the closures will have on the company’s supply chain operations.
