Adam Young was quoted in a September 6 story “TransAm Trucking denied appeal in alleged retaliation case” in Legal Newsline on the U.S. Court of Appeals for the Tenth Circuit’s denial of a trucking company's request to overturn a decision that said it retaliated against a former employee who left a trailer on the side of the road. Young said this decision is surprising, because the driver’s actions probably were not protected under the STAA, which only creates a whistleblower claim for an employee who 'refuses to operate a vehicle because the employee has a reasonable apprehension of serious injury to the employee or the public because of the vehicle’s hazardous safety or security condition.
