AB 2257: Version 2.0 of AB 5, California’s Landmark Independent Contractor Legislation
On January 1, 2020, California’s Assembly Bill 5 (“AB 5”)—landmark legislation that made the “ABC Test” the default standard to determine whether workers are independent contractors or employees—took effect. As businesses are all too aware, AB 5 contained a labyrinthine list of exemptions from the ABC Test, leading to confusion as well as calls from businesses and workers alike for additional and clarifying legislation. In response, on September 4, 2020, California replaced AB 5 with Assembly Bill 2257 (“AB 2257”), which maintains the framework of AB 5, adds new exemptions from the ABC Test and revises others.
