“Can Residents Agree to Lower the Heat Setting?”
Alan Kazlow was quoted in the Real Estate Q & A section of the New York Times in the December 2, 2007 issue of the paper. Alan answered a question from a letter writer who asked whether a condominium or co-op may lower the building’s temperature below the city and state mandated 68 degrees if the owner-residents unanimously agree to a lower temperature for some periods of the day.
Alan notes that New York’s “Multiple Dwelling Law expressly provides that it applies to multiple dwellings ‘rented’ or ‘occupied’ as a residence of three or more families living independently of each other.” He further observes that the state’s Multiple Dwelling Law takes precedence over any private agreement among owners, unanimous or not, and would supersede any local agency’s rules.
