Andrew McKinley Discusses DOL's New Independent Contractor Rule in SHRM

SHRM quoted Andrew McKinley in its article, “DOL’s Rule Narrows Scope of Independent Contractor Classification,” on January 10. McKinley discussed how the US Department of Labor’s (DOL) new independent contractor rule could spark an increase in misclassification lawsuits and make businesses less likely to hire gig workers.

“While the rule will inevitably be challenged in court, workers and businesses will be left to wrestle with the meaning of the Department’s uncertain guidance, its legal viability and ultimately, whether it will shift again with future administration changes.”
