Annette Tyman was quoted in a June 23 story “Attys React To High Court's Affirmative Action Ruling” from Law360 on the U.S. Supreme Court decision in Fisher v. University of Texas which said that the university's race-conscious admissions policy is constitutional, rejecting a challenge by an unsuccessful applicant who claims she was discriminated against because she is white. Tyman said that this is not a ‘one and done’ analysis. Instead, she said that as the affirmative action components of the admission process begin to take hold and evolve over time, universities must gather new data and information to evaluate whether the program continues to be narrowly tailored.
