Ben Conley Discusses Major Gender-Affirming Care Decisions in First Half of 2024 in Law360

Law360 quoted Ben Conley on major gender-affirming care decisions in two articles, “4 Big Gender-Affirming Care Decisions From 2024's 1st Half,” and “7 Gender-Affirming Care Cases To Watch In 2024's 2nd Half.” Conley discussed the major decisions in lawsuits alleging discrimination over restrictions on gender-affirming healthcare from the first half of this year, whether by the state or employers, both public and private.

On the major decisions from the first half of 2024, Conley said,

“There's an onslaught of challenges to gender-affirming care restrictions, including disputes over employers denying claims for treatment and patient-led challenges to state law restrictions.”

Regarding the major decisions for the second half of 2024, Conley pointed out the Pritchard et al. v. Blue Cross Blue Shield of Illinois case, saying

“The Washington federal court's decision seems to say that, even in the context of an employer's plan design where the employer says, 'Hey, [third party administrator], we want you to administer a discriminatory design,' the court there seems to suggest that that would violate Section 1557.”
