Ben Conley was quoted in a February 19 story from Law360, “High Court Ruling May Be A Boon For Benefits Access.” Conley said the Rutledge decision created a road map on how to construct statutes in a way that would avoid ERISA preemption, and there's a good argument to be made that lawmakers followed that road map when creating auto-IRA programs and local health coverage ordinances.
