Cross-border transfers of personal data and technology have been a focal point in recent years. Staying on top of these rules and ensuring compliance can be challenging for companies, with many not knowing where to begin or whether to adopt a country by country or global approach. Join leading global privacy and cybersecurity expert and law firm partner, John Tomaszewski of Seyfarth Shaw, for this BritCham webinar event where he will walk through the various data transfer rules in the UK, Europe and China, the practical impact of these rules, and what companies should consider when creating a compliance framework to deal with them. Along with the differences in the various laws, John will also discuss the similarities in approach between the various countries, including what constitutes “adequate safeguards” at the recipient’s end of the transfer. While these similarities do provide paths forward for cross-border transfers, sometimes these similarities can also create tension in data and technology transfers. Laws/Regulations to be covered include: China’s Cyber Security Law and Personal Information Protection Law, Hong Kong’s Personal Data (Privacy) Ordinance, the UK Data Protection Act and Protection of Electronic Communication Regulations and the EU GDPR. Following John’s presentation, there will be a fireside chat to look at this topic from a practical perspective. SpeakerJohn Tomaszewski, Partner, Seyfarth Shaw LLP John has significant experience counselling companies regarding data protection and information security throughout the Americas, Europe, and Asia. He has prepared data protection documentation for human resource outsourcing companies, cloud service providers, social media companies, and a host of traditional brick and-mortar and emerging-technology clients. John was the first chief privacy officer for CheckFree (now FISERV), where he created internal and external global privacy programmmes for the online bill payment pioneer. In his role as general counsel at TRUSTe, the most successful privacy Trustmark in the world, he ensured that privacy certification programmes were recognised as best-in-class on an international scale. John has been a co-author of several information security and privacy publications and has also provided input to the drafting of various security and privacy laws around the world, including the APEC Cross-Border Privacy Rules system. He is a frequent speaker globally on the topics of cloud computing, Self-Regulatory Organizations ("SROs"), cross-border privacy schemes, and secure e-commerce. |
