While payroll card programs can lower employer costs and benefit employees who do not have bank accounts or who live in rural areas, they are under intense scrutiny from state and federal regulators, the plaintiffs’ class action bar and consumer advocates. In this webinar, Seyfarth Shaw draws on the deep experience of its market-leading Employment Counseling and Consumer Financial Services Litigation practices to offer state-of-the-art advice on how best to avoid and defend against challenges to the legality of these programs.
Seyfarth attorneys will cover topics including:
- Consumer Financial Protection Bureau (CFPB) activity in the payroll card area, including its views on application of the Electronic Fund Transfer Act, Regulation E, and Dodd-Frank’s prohibition of unfair, deceptive, or abusive acts or practices;
- The latest from CFPB, including its proposed rule affecting payroll cards, as announced by Director Richard Cordray on November 13, 2014;
- Enforcement activity at the state level, including investigations by the New York Attorney General;
- The status of the New York Payroll Card Act and other proposed legislation governing payroll cards; and
- Strategies for avoiding and defending against class actions and regulatory enforcement proceedings in this area.
Our panel consists of attorneys with significant experience litigating complex consumer finance and employment issues, including Co-Chairs of Seyfarth’s Consumer Financial Services Litigation and Complex Discrimination Litigation practice groups and the Chair of Seyfarth’s Workforce Restructuring Best Practices Team. This CLE is recommended for in-house counsel.
