Domestic Focused Supply Chain Strategies Take Advantage of Significant Incentives
International concerns and other supply chain issues have prompted many clients to build out a more domestic-focused supply chain. While a healthy job market has chilled state’s aggressiveness on competing for businesses, our Seyfarth team partnered with several clients as they obtained significant incentives for their projects.
As an example, Seyfarth assisted a global client with its acquisition of a greenfield industrial “mega” site for development of a raw material processing facility to supply its US customers. The challenge was to acquire a property that not only satisfied typical real estate criteria (clean environmental, clear title, etc.), but also satisfied engineering, permitting, and other requirements for development of the client’s large-footprint production facility, provided intermodal access, delivered large-volume utilities, and afforded incentives from multiple sources to offset site and facility development costs.
The project called for a legal team with sufficient depth and capacity to work hand-in-hand with the client’s technical and legal teams to ensure all criteria were met. In-house counsel and Seyfarth legal teams’ task was magnified by an accelerated timeline required for construction to meet client’s end production goal date. Seyfarth’s real estate and economic development teams worked together with in-house counsel to manage real estate due diligence, negotiate multiple incentive agreements with various government entities, close the acquisition, and secure all incentives within in the client’s tight timeframe.
