Seyfarth Government Contracts partner Erica Bakies was a featured panelist for BDO’s webinar, “Handling ITAR & Export Control Data: Exceptions for Existing Agreements and Cybersecurity Implications,” on March 20, 2025. The discussion explored the intersection of cybersecurity regulations, such as the Cybersecurity Maturity Model Certification (CMMC), and Controlled Unclassified Information (CUI) within the framework of the International Traffic in Arms Regulations (ITAR). Erica and the panel provided insights into trade compliance best practices, focusing on deemed exports, technical data requirements, and leveraging international legal exemptions, such as AUKUS agreements, to facilitate global defense collaboration while maintaining U.S. data sovereignty.

The webinar also addressed key ITAR exemptions, including Technical Assistance Agreements (TAAs), Manufacturing License Agreements (MLAs), and NATO/Major Non-NATO Ally exemptions. Panelists highlighted how these exemptions enable Defense Industrial Base (DIB) contractors to streamline international operations while ensuring compliance with ITAR regulations. Additionally, the session covered strategies for managing secure enclaves for ITAR-controlled data and leveraging technologies to address design-specific compliance challenges. Attendees left with actionable guidance on implementing these exemptions to enhance efficiency and maintain regulatory alignment.
