On Thursday, May 30, at 3:45 p.m. Eastern, Erica Bakies, senior counsel in Seyfarth’s Government Contracts practice, will serve as the moderator for a session titled, “Bid Protest Appeals:  What Makes the Appeal Different from the Protest,” at the American Bar Association’s 2024 Public Contract Law Committee Showcase Event.

The panel will focus on the unique aspects of bid protest appeals, including how they differ from earlier stages of a bid protest as well as how they differ from other categories of appeals. Panelists will discuss what types of issues resonate on appeal; how appellate briefing and argument are different than earlier stages of the case; and how to balance the highly technical nature of many bid protest issues. Panelists also will discuss practical and strategic considerations, including the likelihood of obtaining a stay pending appeal, the typical timeline of an appeal, and the types of relief that an appellate victory may lead to.
