Recently, the Centers for Medicare & Medicaid Services at Health and Human Services issued a proposed rule to revise federal Stark regulations, specifically with regard to the definitions of fair market value, commercial reasonableness, and the prohibition of “taking into account” the volume or value of a physician’s referrals.

At the same time, the Office of Inspector General at Health and Human Services issued a proposed rule to revise safe harbors under the federal anti-kickback statute and the civil monetary penalty law that prohibits inducements offered to patients.

If these changes become law, they could dramatically affect health care organizations across the country. Proposed comments for these rule changes close on December 31.

We will be joined by senior executives at Health and Human Services, Memorial Hermann Health System, and Houston Methodist for a robust discussion on the proposed rules, along with key developments in recent case law, executive orders, and the Department of Justice Manual on compliance.
