Ken Kanzawa Writes on Adjustments, Preclusion, & Waivers under Contract Disputes Act in Law360

Seyfarth’s Ken Kanzawa authored an article, “Contract Disputes Recap: Adjustments, Preclusion, Waivers,” in Law360 on December 20. Kanzawa discussed three decisions comparing requests for equitable adjustments and claims, forum selection and res judicata, and waiver of penalties for expressly unallowable costs.

“Contractors should proactively establish policies, employee training, and internal control systems. When it comes to indirect cost rate proposals, establishing these types of measures after-the-fact is something the government will appreciate, but it will not preclude liability for penalties.”
