If you have read our Cal-Pecs Blog and Management Alerts, you’re aware of the new employment laws signed this year.  But are you ready for the January 1, 2014 effective date?  Join members of our California Workplace Solutions Group on December 11, 2013, for a discussion of how these new laws may affect employers doing business in California, highlighting any latent implications of the new laws, and suggesting practical tips for ensuring your business is prepared and your policies and procedures are fully compliant.

Our discussion will include:

  • Changes to protected statuses, pre-employment inquiries, and leaves of absence / time off work
  • New retaliation prohibitions for immigration-related practices
  • New wage and hour laws including:
    • Minimum wage increase and liquidated damages for failure to pay minimum wage;
    • Penalty for failure to remit withheld wages to the appropriate agency;
    • No administrative exhaustion requirement for certain Labor Code provisions;
    • Up to $10,000 penalty on employers for violation of Labor Code section 98.6;
    • Amendment to Labor Code section 226.7 to include “recovery periods”; and
    • Domestic workers bill of rights.
  • Farm labor contractor successor liability
  • Governor’s VETO of the law that would have modified the mixed-motive instruction (prompted by the ruling in Harris v. Santa-Monica)
