Noah Finkel Discusses Potential Issues Arising From "No Tax on Tips" Plan in Law360

Law360 quoted Noah Finkel in its article, “’No Tax On Tips' Would Complicate Wage Disputes, Attys Say,” on August 16. Finkel discussed how the proposals to eliminate federal taxes on tips for workers, in at least some industries, could intensify disputes regarding what counts as a tip and dampen the push to eliminate a tipped subminimum wage.

“Because there's more of an advantage for employees in claiming a service charge to be a tip, if legislation were to pass and be signed, it then would raise the stakes of that litigation because then the relief that the employees could get wouldn't be taxed.”
