Preparing fact witnesses for a jury trial may be the single most challenging task in getting ready for trial. The witnesses are the human face of your case. The jury will be listening to and watching the witnesses closely, and weighing their credibility. Many witnesses are very nervous about testifying, and they may be asked to testify about details of events that occurred years earlier. Adding to the challenge is the fact that trial is notoriously unpredictable.
The next installment in our Trial Education Series, “Ready or not, Here Comes Trial: How to Prepare Your Witnesses for the Courtroom,” will focus on the importance of witness preparation in advance of a trial. Specifically, our presenters will address:
-
Establishing a rapport with your witness
-
How to define the witness’ role
-
Witness credibility and mannerisms
- Cost-benefit analysis
