Seyfarth Partner Randel Johnson Appointed to Department of Labor’s Administrative Review Board

WASHINGTON, D.C. -- (August 3, 2020) - Seyfarth announced today that Randel K. Johnson, partner from the firm’s Labor & Employment department in Washington, D.C., has been appointed as member of the Department of Labor’s Administrative Review Board (ARB) for a two-year term.

The ARB issues decisions on behalf of the Secretary of Labor in cases arising under a wide range of worker protection laws, primarily involving environmental, transportation, and securities whistleblower protection; H-1B immigration provisions; child labor; employment discrimination; job training; seasonal and migrant workers; and federal construction and service contracts.

ARB’s cases generally arise upon appeal from decisions of the Department of Labor’s Administrative Law Judges or the Administrator of the Wage and Hour Division. The Board’s decisions become the final decisions of the Secretary unless he undertakes discretionary review. Depending upon the statute at issue, the parties may appeal the ARB’s decisions to federal district or appellate courts and ultimately to the U.S. Supreme Court.

At Seyfarth, Johnson was a leader in the firm’s Government Relations and Policy practice group where he provided his legal expertise to clients regarding the actions of Congress and federal, state, and local administrative agencies. Prior to Seyfarth, Johnson served as senior vice president at the U.S. Chamber of Commerce for two decades, where he was primarily responsible for labor, immigration, and employee benefits issues pending before Congress and the federal agencies.

Before joining the U.S. Chamber of Commerce, Johnson was labor counsel and coordinator for the U.S. House of Representatives Committee on Education and the Workforce where he was responsible for employment policy and legal issues before the committee.
