John Napoli, co-managing partner of Seyfarth’s New York office, Catherine Burns, partner in Seyfarth's Boston office, and Miles Borden, co-head of Seyfarth's New York real estate practice, will speak at the U.S. Real Estate Opportunity & Private Fund Investing Forum (IMN)’s 24th Annual Summer Forum in Newport, Rhode Island from June 19-21. John will serve as the moderator for "Now Is It Wait To Fix in ’26? Workouts & Restructures" on June 20. The session will cover what kind of discounted payoffs are out there, using a 721 exchange, asking for a loan modification: what you need to know, capital calls, keys to successfully working with special assets and special servicing, what to know about having or being in a mezz, preferred or in another place in the capital stack, comparing loan types: CMBS, CLO, balance sheet, syndicated loan or warehouse line, refinancing debt vs. exchanging for equity, and impact of why in default… Underperformance vs. maturity default vs. covenant violation.
Catherine will serve as the moderator for "Multifamily: Where Are Your Favorite Markets As The Refinancing Crisis Hits?" on June 20. This panel will highlight how to convince investors that multifamily is still the place to be, where the rent/home affordability equation is now, refinancing, market liquidity and pricing update, macroeconomic market outlook, and how do you see the current multifamily financial distress problem playing out?
Miles will serve as a panelist for "Transitioning From an Emerging to an Established Fund Manager" on June 20. This panel will highlight when to start your second fund, top concerns and pain points of launching and managing the first fund and how are those being addressed in subsequent fund launches, fees structures and economics, changes in capital raising strategies and reporting requirements, new compliance considerations or changes to existing compliance structures, and increased investor transparency.
