Colorado’s daily overtime and meal and rest break requirements for non-exempt employees, as well as its different duties requirements for exempt employees, will apply to all employers who meet the definition of an “employer” under the federal Fair Labor Standards Act as of March 16, 2020. And as of July 1, 2020, its separate salary level requirements for exempt employees will apply as well. These are just the highlights. The new rules and the explanation of the rules provided by the Colorado Department of Labor and Employment, Division of Labor Standards and Statistics contain quite a few significant wage-hour requirements that pose new interpretation and compliance challenges for employers with respect to both their non-exempt and exempt employee populations.
