Since the start of the COVID-19 pandemic, employers have been given a crash course in managing remote workforces, accommodating diverse employee-related issues, and maintaining continuity of operations in the face of unprecedented change. As states and employers begin to reopen and return to “normal” operations, employers should be aware of potentially significant wage & hour pitfalls—including issues relating both to employees working from home and employees returning to the workplace.

Seyfarth attorneys  and a former Senior Wage & Hour Investigator for the Department of Labor participated in a virtual panel discussion on recent wage & hour developments, including best practices for managing your workforce in the COVID-19 era.

This business-critical discussion included topics such as:

  • Identifying and avoiding wage & hour issues in your non-exempt workforce, including temperature checks and other “off-the-clock” work claims, expense reimbursement issues, and meal and rest break considerations.
  • Managing your exempt workforce to limit wage & hour issues, including the effect of furloughs on the salary-basis test and misclassification issues stemming from a reduced workforce.
  • Other issues, such as the effect of hazard pay on the regular rate, potential legal challenges to modified incentive and commission plans, and expected independent contractor-related lawsuits.
  • Recent developments at the Department of Labor, Wage and Hour Division, including updates to the fluctuating workweek and the Section 7(i) exemption for retail establishments.
  • Best practices and strategies for handling Department of Labor investigations.
