About the Program
The Supreme Court’s very recent decisions in the Students for Fair Admissions cases involving UNC and Harvard, summarized here, address critical issues in the cultural flashpoints facing society today. While the decisions are focused on challenges to the direct use of race in university admission processes, the decisions provide useful insights for employers on the various Diversity, Equity, Inclusion, and Belonging initiatives many employers undertake for business and/or legal reasons.
Join our experts for a discussion of these decisions and potential impacts on employers, including:
- The distinction between affirmative action in education versus employment
- The continued viability of voluntary affirmative action programs and narrow affirmative defenses available under Title VII for addressing “manifest imbalances” in the workplace
- Permissible diversity, equity, and inclusion (DEI) initiatives, including for sourcing and recruiting
- OFCCP-mandated affirmative action; and
- Messaging given questions and scrutiny employers are likely to face.
