Anne’s practice includes state, federal, and international trademark and trade dress clearance, registration, maintenance, and enforcement, as well as domestic and international management of trademark and trade dress portfolios. She has been managing counsel in almost every nation in connection with trademark and trade dress clearance, registration, maintenance, enforcement, and licensing. Anne conducts or manages domestic and international investigations concerning unauthorized third-party trademark, trade dress, and copyright use. She handles dispute resolution—including settlement negotiations, federal and state litigation, inter partes and ex parte proceedings before the US Trademark Trial and Appeal Board, and UDRP proceedings. Anne assists clients with domain name selection, acquisition, registration, maintenance, and enforcement, as well as strategic domain name portfolio development, maintenance, and protection—both offensive and defensive.
Anne helps her clients with internet and social media matters, including intellectual property enforcement though the DMCA and other available avenues, recovery of usernames and handles, cessation of auctions, online advertisements, and sales of counterfeit or unauthorized merchandise. Additionally, she reviews advertisements and other publications and marketing materials to determine intellectual property and regulatory compliance and the risk of challenge from regulators and competitors.
Anne assists clients with creating and implementing solutions and procedures for increasing and streamlining proactive communication between legal and nonlegal teams regarding launching new products, services, slogans, and promotions. She helps with federal copyright registration and enforcement, drafting and negotiating intellectual property and marketing-related agreements, and conducting due diligence for transactions involving intellectual property. Anne advises her clients on the legality of proposed sweepstakes, contests, and promotions; drafting and reviewing the official rules and related documents for sweepstakes, contests, and promotions; and registering and bonding sweepstakes when required.
