In order to maximize these opportunities and minimize the risks, experienced counsel can add significant value throughout the process, including contract drafting and negotiations, day-to-day project advice during performance, and any dispute resolution matters that may arise. - Represented an international construction consortium performing the multibillion-dollar Third Set of Locks Project in connection with the expansion of the Panama Canal. Matter involves numerous Dispute Adjudication Board and ICC proceedings.
- Represented a construction contractor with respect to contract disputes concerning the construction of $180 million condominium project in Virginia. Obtained summary judgment on behalf of client on contract issues and fraud issues, and complete trial victory on remaining claims. Also prevailed on related appeals in the US Court of Appeals for the Fourth Circuit and the Virginia Supreme Court.
- Represented a national general contractor in preparing a construction claim against the US Government relating to the design and construction of a $150 million national headquarters of a federal agency. - Represented an international contractor in connection with various disputes related to hydroelectric projects in Costa Rica and Honduras, which were resolved favorably prior to formal dispute proceedings.
- Represented national contractor in connection with a $200 million construction project in Maryland for the U.S. Government’s National Institutes of Health. Representation involved preparing and pursuing claims in excess of $30 million on behalf of the contractor and litigation with various subcontractors in state and federal court. All disputes were ultimately resolved on favorable terms for the contractor.
- Represented a general contractor in preparing and prosecuting claims against the US Government arising from a $100 million design-build project. The claim involved complex environmental issues and the Government’s failure to disclose certain environmental conditions at the site. Resulted in a multimillion-dollar settlement for the contractor.
- Numerous contract negotiations involving modified versions of various industry documents, including AIA, AGC, DBIA, and FIDIC
