More About Nick

Nick's career spans both private and public sectors with a mix of legal policy work in safety regulation, operational safety law advice, and complex safety litigation across a diverse range of industries. Before joining Seyfarth, he was the senior safety solicitor for the New South Wales Police Force, and prior to this, he was a senior lawyer with the Federal Work Health and Safety regulator, Comcare. He has proven outstanding results in both prosecuting and defending alleged breaches of workplace safety laws, and developing front-end compliance systems to improve safety outcomes within large and complex organisations. 

Having worked in-house for a safety regulator, Nick understands the political, legal, and practical considerations that underpin regulatory decision-making. That experience informs his safety law practice and allows him to think laterally and explore alternative engagement strategies with regulators. Nick also has experience in providing front-end practical safety law advice to operational law enforcement agencies with diverse safety risk profiles.

Nick's experience includes:

Litigation

  • Prosecuting for offences against federal workplace safety laws including matters where the maximum statutory penalty was imposed.
  • Defending alleged breaches of mine safety legislation.
  • Appearing before Fair Work Commission and New South Wales Industrial Relations Commission in relation to workplace safety disputes and statutory notices issued under work health and safety laws.
  • Preparing for and assisting clients during coronial inquests.
  • Negotiating and drafting enforceable undertakings to resolve safety-related disputes as an alternative to safety prosecutions.

Advisory

  • Reviewing policies, procedures, and safety management systems to mitigate critical safety risks across diverse industries—government sector, mine safety, marine safety, civil construction, and retail and transport sector.
  • Successfully challenging statutory improvement and prohibition notices issued to clients across different sectors.
  • Assisting clients during critical incident response and the remainder of safety regulatory investigations.
  • Providing training seminars to workers and senior management on obligations under safety law.
