Will counsels and defends clients in a wide variety of high-stakes—and often bet-the-company—litigation matters, including securities litigation and enforcement, fiduciary duty claims, patent litigation, and product liability litigation.

Directors, officers, and their companies face serious liability and potential damages issues when facing claims from stockholders or governmental regulators, such as the SEC. As chair of the Securities, Financial and Directors & Officers Litigation group, Will brings 30 years of experience in counseling and defending such cases, covering a wide variety of issues, with excellent results.
In patent cases, clients often face bet-the-company situations when asserting or defending patent infringement cases. Will has successfully litigated dozens of patent infringement cases, including at trial, over the past three decades. These cases have included patents covering travel goods and airport security, oil and gas technology, recycling technology, dental products, laser angioplasty, and encoded pay-per-view television technology.
For product liability, Will defends major manufacturers in worldwide toxic tort litigation filed by class plaintiffs alleging harm from use of clients' products.
Will is a trained litigator, having started his career in 1989 at one of the largest law firms in the US. As such, he brings a level of rigor, thoroughness, and attention to detail that is the hallmark of such training. In addition, Will brings the depth of experience that can only be gained through decades of experience.
- Will is currently counseling the audit committee of a Fortune 100 company involved in an SEC investigation into certain accounting treatments over multiple reported quarters. This challenging engagement includes working arm-in-arm with company counsel in conducting an extensive internal investigation, negotiating with the SEC and the company's outside auditors, and defending claims brought by various claimants.
- Will recently defended a China-based issuer listed on NASDAQ and some of its directors and officers in a securities class action brought in the US District Court for the Southern District of New York. He was able to obtain dismissal of several of the individual defendants, and negotiated a de minimus settlement for the remaining defendants covered entirely by directors & officers insurance proceeds that was well below policy limits.
- In product liability litigation, Will recently obtained a decision by the Supreme Court of South Korea, ruling in favor of his client and reversing a lower court judgment. In this decade-long case, the client was sued by a class of more than 17,000 plaintiffs, and the Supreme Court reversed the adverse lower court judgment, which was in excess of $100 million.
Will is a big believer in, and user of, the firm's advanced service delivery tools, including case mapping to help predict, monitor, and control litigation cost and dashboards to provide clients with real-time, 24/7 access to work product, monitoring of project progress, and team member billing-to-date.
