While able to represent contractors in a wide variety of government contracting issues, Zach focuses on representing clients in negotiated contract changes, requests for equitable adjustments, claims, and claim appeals before the contract appeals boards, the US Court of Federal Claims, and the US Court of Appeals for the Federal Circuit.
In addition to claims litigation, Zach represents clients in disputes with other government contractors, to include prime-sub and teaming disputes, in federal court and through alternative dispute resolution, as well as in bid protests before the Government Accountability Office (GAO) and US Court of Federal Claims. Zach also specializes in guiding contractors through complex issues related to data rights that arise under government contracts, subcontracts, and supplier arrangements, with an emphasis on license agreements, data rights assertions, and data markings, in order to protect contractor intellectual property interests. While Zach primarily works in federal procurement, his practice also frequently includes grants, cooperative agreements, other transactions, and contracts with state and local governments.
For more than eight years as a Judge Advocate and civilian lawyer for the US Army Corps of Engineers and for the Department of the Army, Zach counseled government clients—including program managers, contracting officers, and senior military and civilian officials—on a broad range of procurement and related issues, including program development and project management within the Army’s civil works, military construction, and foreign military sales missions. While an agency counsel for the US Army Corps of Engineers, Zach advised contracting officers on contract administration issues related to large construction contracts all over the world, including while detailed to field offices in Japan, Afghanistan, and the southern US border. While a trial attorney for the Department of the Army, Zach developed extensive experience in contract claims litigation before the Armed Services Board of Contract Appeals and in bid protests at the GAO.
