We handle matters for clients that cover a broad range of issues, including commercial lease disputes, lease renewal issues, restrictive covenants, easements, non-payment matters, purchase agreement disputes, title disputes, land use disputes, illegal detainer actions, as well as condominium association and co-operative corporation governance and election disputes and Board/owner disputes, partnership disputes, partition actions, ADA matters, and brokerage commission claims, among others. We litigate matters involving bankruptcy claims, workouts, foreclosure matters, and guarantees in the real estate context, as well as construction and mechanic's lien matters. As an added value to our clients, we employ our industry-leading advanced service delivery platform to achieve greater predictability in billing by offering alternative fee arrangements such as flat rates and fixed pricing for specific phases in certain types of real estate litigation. Likewise, members of our Real Estate Litigation team have collaborated with our Lean Solutions team to develop graphic depictions of the workflow and steps needed for mortgage foreclosures, franchisee evictions, and real estate-related bankruptcy matters. - Obtained an injunction on behalf of commercial landlord prohibiting tenant’s interference with landlord’s build-out of other tenants’ spaces, which involved construction activities performed in the tenant’s space, and successfully defended against tenant’s counterclaim for fraudulent inducement of the lease and for constructive eviction.
- Obtained judgment on behalf of commercial property owner in quit title action through adverse possession regarding multiple parcels omitted from a commercial sale agreement.
- Successfully defended institutional investor against claim for breach of an $8 million sale-leaseback agreement, as well as claims for promissory estoppel and breach of duty of good faith and fair dealing, when investor exercised termination rights under letter of intent.
- Successfully represented shopping center owner against commercial tenant in dispute regarding unpaid common area maintenance charges, real estate tax allocations, administrative expense allocations, and administrative salary allocations under the parties’ lease.
- Successfully defended owner of retail complex against claim by a built-to-suit big box retailer alleging that excess vapor moisture in the concrete slab affected carpet flooring materials and retailer’s use and enjoyment of the leased space, where design and construction were in accordance with retailer’s plans and specifications.
- Entirely defeated a $32 million damages claim of commercial unit owner against a condominium board after more than seven years of contentious litigation, a finding of liability and an eight-day causation and damages hearing with 15 witnesses, involving complex issues of condominium governance, construction, insurance, and development rights.
- Obtained arbitration panel award for a co-brokerage commission after exclusive agent cut client out of an over $8 million sale.
- Obtained order granting commercial tenant's motion to dismiss contractor's untimely filed mechanic's lien.
- Obtained judgment of possession against commercial tenant based upon its default under a franchise agreement.
